Permanent Business Visa

Business Talent (Permanent) visa (Subclass 132)

The Business Talent visa allows you to stay and run a business in Australia for an indefinite amount of time. It is a permanent visa available to applicants in two streams

 

Significant Business History Stream: for people with ownership interests in large businesses


Venture Capital Entrepreneur Stream: for people who have access to venture capital funding of at least AUD 1 million.

You need to meet the eligibility requirements to obtain this visa

  • You must be sponsored by a State/Territory government
  • You must have an overall successful business career
  • You should be able to prove that you have an ownership interest in the business with an annual turnover of at least AU$3million (each year)
  • Your business and personal assets (including your spouse) must have a net value of at least AUD $1.5million available to support your business in Australia and are lawfully acquired and available for transfer to Australia within 2 years of the grant of your visa
  • You are aged less than 55 at time of application, or you are proposing to establish or participate in a business that your sponsoring State/Territory has determined is of exceptional economic benefit to the State/Territory
  • You should not be involved in any impermissible business or investment activities
  • You have a genuine and realistic commitment to establish or participate actively in a qualifying business in Australia

 

State/Territory Nomination

This visa is only available to applicants who are nominated by an Australian State or Territory government.

Business Innovation and Investment (Permanent) Visa (Subclass 888)

The Subclass 888 Business Innovation and Investment visa is a permanent visa that you can obtain after you have stayed in Australia on the subclass 188 Business Innovation and Investment visa. There are two streams for this visa type which depends on which stream was applied for at the provisional visa stage.

 

Business Innovation Stream: 

requires you to have established a business in Australia which meets certain asset and turnover requirements.

 

Investor Stream: 

You must have held an investment in Australia for 4 years

Business Innovation Stream Eligibility Requirement

You will need to meet the following if you are applying through the Business Innovation Stream:
  • Residence Requirement: you must have been in Australia for at least 1 complete year out of the 2 years prior to filing your application.
  • You have had an ownership interest in an Australian business for the last 2 years
  • Your business has an ABN and has lodged the necessary Business Activity Statements (BAS) for the last 2 years
  • The business has had turnover of at least AUD 300,000 for the last 12 months. Exception: if you reside in a regional area, operate a business there and the State or Territory Government has indicated there are exceptional circumstances

 

Investor Stream Requirement

For this option, you must have held an Investment Stream Subclass 188 provisional visa, and meet the following criteria:

  • Residence Requirement: you must have been in Australia for at least 2 of the last 4 years
  • You must have maintained the AUD 1.5 million investment in Australian Bonds for the continual 4 years that you have been in Australia.

State/Territory Nomination

This visa is only available to applicants who are nominated by an Australian State or Territory
government.
